ORDINANCE NO. 168

 

AN ORDINANCE OF KENNETT TOWNSHIP, CHESTER COUNTY, PENNSYLVANIA, PERMITTING THE ENTERING INTO OF A CABLE FRANCHISE AGREEMENT GRANTING A NONEXCLUSIVE FRANCHISE TO VERIZON PENNSYLVANIA, INC., TO CONSTRUCT, INSTALL, MAINTAIN, EXTEND, AND OPERATE A CABLE COMMUNICIATIONS SYSTEM IN KENNETT TOWNSHIP.

 

WHEREAS, Verizon is in the process of installing a Fiber to the Premise Telecommunications Network for the transmission of non-cable services in the Township and desires to use portions of the Network once installed to provide cable services in the Township;

 

WHEREAS, Kennett Township wishes to grant Verizon Pennsylvania, Inc., a nonexclusive franchise to construct, install, maintain, extend, and operate a cable communications system in Kennett Township, in accordance with Title VI of the Communications Act of 1934, as amended, 47 U.S.C. §521 et. seq.;

 

WHEREAS, Kennett Township and Verizon Pennsylvania, Inc., have reached agreement on the terms and conditions of said franchise; and

 

NOW, THEREFORE, the Board of Supervisors of Kennett Township, Chester County, Pennsylvania, hereby enacts and ordains as follows:

 

            Section 1.        Kennett Township hereby permits the entering into of a Cable Franchise Agreement with Verizon Pennsylvania, Inc., to construct, install, maintain, extend, and operate a cable communications system, the specific terms of which, agreeable to both parties, shall be memorialized in said Agreement.

 

            Section 2.  If any sentence, clause, section or part of this ordinance is, for any reason, found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts hereof.  It is hereby declared as the intent of the Board of Supervisors that this ordinance would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.

 

            Section 3.  All ordinances or parts of ordinances conflicting with any provisions of this ordinance are hereby repealed insofar as the same affects this ordinance.

 

            Section 4.  This amendment shall be effective 5 days following adoption, as by law provided.
