PLANNING COMMISSION MINUTES

CALL TO ORDER: The minutes from the July 1, 2008 meeting were approved as distributed.
ANNOUNCEMENTS:
1. There will not be a work session in August.
2. John Haedrich announced that the Route 52 Bikeway will hold a meeting on August 6, 2008 at 6:00 p.m.
3. Jim Guthrie stated that the Kennett Township Land Trust has eased the Whittle property with the assistance of County grants and funds from the Township.
Act 537
Bob Listerman gave a presentation for the Act 537 proposal
suggesting that the subcommittee explore increased capacity at the Borough plant
and start stream discharge as new business taps into increased capacity.
New businesses would pay a tap rate commensurate to do land application.
Bob Listerman stated that the cost for constructing and implementing a spray
irrigation system is estimated to be $28 million and there are no current
applicants to offset the cost. The subcommittee will get legal council on the
proposal and request that they continue pursuing land application from the Board
of Supervisors. A meeting will be
held with the other participating municipalities in September.
The subcommittee will also have discussions with DEP regarding approval
for this proposal.
Bob Listerman moved that the Commission continue to pursue spray
irrigation with legal advice from the Township Solicitor as to feasibility with
the proposed plan layout. Bill
Hewton seconded the motion and it carried with all in favor.

Chris Alonzo presented this proposal to build a restaurant located on Route 52 with Adam Bower, applicant’s engineer. He stated that Gilmore Associates submitted a letter stating that the plan is in compliance, Anne Walters, Township Architect, submitted a letter with outstanding issues and the applicant is waiting for a review letter from URS. Adam Bower stated that he received a review letter from URS and is working on the outstanding issues. All action was deferred.
Shepherd Property – Conditional Use – Article XVII
Mr. & Mrs. Shepherd were present. The applicant is proposing 12 lots and one lot will contain the historic house under Open Space Design Option Article XVII. Bill Hewton presented this proposal currently under review for Conditional Use approval. He gave a time line of the proposal since the submission for Conditional Use application including reviews, site walks and meetings with John Snook, Brandywine Conservancy. Bill Hewton reviewed John Snook’s revised plan along with the recommendations for the property. The subcommittee met to review the revised plans. The applicant will submit these plans for review by the Township Engineer in preparation for Conditional Use approval. Jim Guthrie stated that this proposed plan is a significant improvement from the original plan and with this specific plan it makes sense to waive the maximum of eight (8) homes for a cluster requirement. Matt Sabo agreed that a formal waiver in this case should be recommended for the number of houses proposed. Mr. & Mrs. Shepherd stated that they are in agreement with the proposed plan but may want to relocate the open space access point to another location. Sara Meadows, Historic Commission, supported the proposed plan which has sensitivity to the historic house and the scenic areas. An extension letter was submitted until November 1, 2008. All action was deferred.

Jim Guthrie presented this proposal to create 24 townhouses on 9.33 acres located on Union Street in the R-4 district with David D’Agostino, applicant, Wendy McLean, applicant’s attorney and Adam Bower, Engineer were all present. Lisa Thomas, Landscape Architect, reviewed the proposed landscape plan. The major outstanding issue is the easement for storm water management. John Haedrich expressed concerns with a woodchip walking path instead of a more permanent surface. Bob Johnston will discuss the proposed trail material with Anne Walters. An extension letter was submitted until October 31, 2008. All action was deferred.

Bill Hewton presented this proposal to construct a carwash located on Millers Hill with no one present representing the applicant. He gave a brief summary on the project reviews by Gilmore Associates, URS, Chester County Planning Commission and Anne Walters and stated that a meeting between Gilmore and Concord Planning has been held to review all of the review letters. An extension letter was submitted until 10/31/2008. All action was deferred.
